Germany's Hesse Targets Israel Denial with New Criminal Law
Hesse Prime Minister Boris Rhein and Justice Minister Christian Heinz are set to formally unveil the corresponding legislation Thursday, with the bill earmarked for introduction in Germany's upper chamber, the Bundesrat, on May 8. Further specifics of the draft have yet to be disclosed.
The initiative is not without precedent within the state. Hesse's Justice Ministry had already lobbied for a new criminal provision along these lines in 2023, citing social media posts as a key area of concern.
The proposal, however, has met with sharp resistance. Critics contend the legislation is less about combating antisemitism and more about suppressing any form of criticism directed at Israel.
Their concerns find grounding in current German legal frameworks. Under existing law, questioning Israel's right to exist does not constitute a criminal act. And while German authorities have moved aggressively to curtail pro-Palestinian expression since October 2023, courts have recently pushed back — ruling that such speech broadly falls within the protections afforded by freedom of expression.
The proposed bill arrives against a charged political backdrop. Since Israel launched its military offensive against the Gaza Strip on Oct. 7, 2023, Germany has witnessed a sustained wave of mass protests condemning Israel's conduct in the enclave.
